ORDER CANCELLING HEARING
AND SETTING BRIEFING SCHEDULE
In light of the parties’ stipulation (doc. 22), the Court
CANCELS the consolidated bench trial and preliminary-injunction
hearing set for July 16, 2012. Additionally, the Court ADOPTS the
briefing schedule agreed upon by the parties. Thus, the procedure
for moving forward in this case shall be as follows:
(1) Plaintiffs must file their evidence with the Court no
later than July 16.
(2) Defendant shall have until July 17 to file the
administrative record, along with any evidence or other
materials it believes should be considered by the Court.
(3) Each party may then file a motion seeking to exclude any
part of the other party’s evidence no later than
August 7. If such a motion is filed, the proponent of
the challenged evidence shall have twenty-one (21) days
from the date of the motion’s filing to file a response.
(4) Once the Court has ruled upon all motions filed by the
parties concerning the scope of the record in this case,

the parties shall submit a proposed briefing schedule
concerning resolution of the merits of Plaintiffs’
claims.
